Terms and Conditions for use of MindAlpha Diagnostics
1. Introduction
These Terms and Conditions govern participation in workplace surveys, assessments and diagnostics ("Diagnostics") conducted by MindAlpha (“Company”). By participating in these Diagnostics, respondents and other interested parties (“Users)” acknowledge and agree to these terms.
2. Purpose of the Survey
The Diagnostics are intended to gather insights into employee experiences, workplace culture, and organisational effectiveness. The data collected will be used to generate anonymised and aggregated analysis for the purpose of improving the workplace and working environment.
3. Intellectual Property
All methodologies, survey questions, data analysis techniques, reports, and recommendations produced by the Company are the exclusive intellectual property of MindAlpha. Interested parties may be granted a non-exclusive, non-transferable licence to use final reports for internal business purposes only, they may not reproduce, distribute, or modify these reports without prior written consent from MindAlpha.
4. Confidentiality and Data Protection (see below for more details)
MindAlpha will handle all data gathered during diagnostic processes in accordance with applicable data protection laws and maintain the confidentiality of all participants.
MindAlpha will ensure that data shared with users is anonymised and aggregated to protect personal privacy.
5. Liability and Indemnity
MindAlpha makes no guarantees regarding the accuracy, completeness, or effectiveness of the diagnostic results or of any recommendations made on them.
Users acknowledge that decisions made based on the Diagnostic results are their responsibility, and the Company shall not be held liable for any outcomes arising from the use of the information provided.
Users agree to indemnify and hold MindAlpha harmless against any claims, damages, or liabilities arising from the User’s use of the Diagnostic results.
6. Use of Findings
The Diagnostic findings are intended for internal strategic and operational improvements only.
Users shall not use the Diagnostic findings in any external communications, promotional materials, or public statements without prior written approval from MindAlpha.
7. Amendments and Termination
MindAlpha reserves the right to amend these Terms and Conditions with prior notice to Users. Either party may terminate any association in writing, subject to any contractual obligations in place.
8. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Kingdom, and any disputes shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

Privacy Policy for MindAlpha Diagnostics
1. Introduction
This Privacy Notice governs participation in workplace surveys, assessments and diagnostics ("Diagnostics") conducted by MindAlpha (“Company”). By participating in these Diagnostics, respondents and other interested parties (“Users)” acknowledge and agree to these terms.
2. Purpose of MindAlpha Diagnostics
MindAlpha Ltd has created these tools to better understand workplace behavior and the working environment. The insights will help identify areas for improvement and enhance workplace culture.
3. What Data We Collect
Participation is voluntary unless specifically stated. We may collect:
Your responses to behavioural assessments, diagnostics and surveys.
Your answers to decision-making pattern, communication style and preference assessments. Cognitive style and problems solving metrics.
Demographic information (e.g., gender, age, ethnicity, work location, organisation type, job type).
4. How We Use Your Data
Your responses will be used for research and reporting purposes. We analyze data at an aggregated level, ensuring that no individual can be identified in the results we publish or provide to users. The demographic data does not affect confidentiality. In the event that we use personalised survey links for individuals, MindAlpha will keep all ID data separate from survey or assessment responses and will delete this data after 6 months. We use this data solely to assure the quality and validity of the assessment and will never publish or report back on individual responses.
5. Legal Basis for Processing
We process this data under Legitimate Interest and Consent (chosing to participate will be deemed to be consent) ensuring that responses contribute to meaningful workplace insights.
6. Data Security & Confidentiality
Responses to Diagnostic assessments are stored securely and protected from unauthorized access.
Only authorized MindAlpha personnel will have access to the raw data for analysis.
7. Your Rights
You have the right to:
Request access to your data and responses (if identification is possible).
Ask for corrections if needed (if identification is possible).
Withdraw your data (if identification is possible) before results are finalized.
